The Court hereby schedules the criminal jury trials of the following cases to appear on the Court's January 30, 2023 Criminal Jury Trial Calendar at 9:00 a.m. before this Court. Counsel for the parties and Defendant shall report to Courtroom 8C, Judicial Center Tower, 185 Central Avenue, S.W., Atlanta, Georgia 30303 on that date at the foregoing time. Should the Defendant be in custody, he/she will be produced by the Court, accordingly. Counsel for all parties are ORDERED to appear ready for trial. Cases not reached on this trial calendar, will "rollover" to all subsequent trial calendars until reached. The Court will not necessarily call cases to trial in the order they are listed. Counsel is expected to announce "ready for trial" in connection with all of the listed cases. Counsel is hereby further placed on notice the Court is disinclined to grant any continuances from the trial calendar, absent a proper showing of good cause. All conflict letters must be filed in accordance with the law. The filing of a conflict letter does not excuse counsel from appearing in court, unless there is an actual conflict preventing counsel from appearing. Furthermore, this Court will not honor any Leaves of Absence, filed after the entry of this Order, which include the dates January 30, 2023 through February 10,2023. Counsel must file any Motions in Limine and Requests to Charge Jury no later than 11:59 p.m., January 23, 2023. Counsel shall send proposed general Voir Dire questions to the Court. Counsel shall send a courtesy copy of any such Motions in Limine, Requests to Charge Jury and proposed general Voir Dire questions to the Court's Litigation Manager, Mr. Wayne Dixon, no later than January 23, 2023. His email address is [email protected] It is the responsibility of counsel to ensure Mr. Dixon has received the documents referenced herein. Pattern Jury Charges shall be listed on a single cover page identifying each charge by name and paragraph. Counsel SHALL NOT include the text of any such Pattern Jury Charges. Each party is limited to 15 Non-pattern Jury Charges, unless leave to file additional Non-pattern charges is sought and obtained in writing from the Court. All Non-pattern Jury Charges must include the text of each charge and the case/statute citation which support the respective charge. Each Non-pattern Jury Charge shall be listed one to a page and each page must be numbered. ALL JURY CHARGES THE LISTING OF PATTERN CHARGES, AS WELL AS, THE
INDIVIDUALLY SUBMITTED NON-PATTERN CHARGES SHALL BE SUBMITTED
TO THE COURT IN WORD FORMAT.
B. FINAL PLEA CALENDAR
The Final Plea Calendar for cases on a trial calendar or the first time will occur on January 27, 2023 at 9:30am in Courtroom 8C. Defense counsel MUST appear in-person in court for the Final Plea Calendar. The foregoing date is the last date the Court will consider accepting a negotiated plea in such cases. Any resolution by plea after January 27, 2023 will be as a result of a non-negotiated plea made without the opportunity to withdraw it after sentence is pronounced by the Court. There is no need for counsel and parties to appear for this Final Plea Calendar IF your case was scheduled on a previous Final Plea Calendar. Counsel is expected to appear at the Final Plea Calendar prepared to make an announcement at calendar call as to whether there will be a plea. All pretrial negotiations must be completed and offers communicated by defense Counsel to Defendant BEFORE the final plea calendar date. The Court will not allow the final plea calendar's progression to be delayed as a result of "last minute" plea negotiations.
