JUDGE EDLEIN, CIVIL PRE-TRIAL CONFERENCE CALENDAR

In accordance with the Supreme Court of Georgia's Orders, as amended, permitting courts to use technology to conduct remote judicial proceedings, the Court will conduct its Civil Pre-Trial Conference Calendar via videoconference. The following civil cases have been set for Pre-Trial conferences on Monday, August 21, 2023 at 3:30 P.M. via Zoom videoconference. Attorneys and self-represented parties shall appear via Zoom. The parties must appear in such a way to be seen and heard by the Court and all parties. The Court will use Zoom https://zoom.us/ which is available for free. The Zoom hearing information is at the end of this Notice. Parties may also request an electronic videoconference notice by emailing the Court's Judicial Assistant, Kimberley Davis, at [email protected]. If any party does not have access to the internet or Zoom, contact Ms. Davis via email or at 404 613-0490 immediately. Failure to appear at the Pre-Trial Conference may result in DISMISSAL of the Complaint with prejudice or STRIKING of the Answer and/or counterclaims. THERE WILL BE NO CONTINUANCES FROM THIS CALENDAR, EXCEPT FOR LEGAL CAUSE. ONLY JUDGE EDLEIN CAN CONTINUE A CASE FROM THIS CALENDAR. All requests for continuances must be in writing. Court Reporter: Parties shall provide their own court reporter. Settlement/Dismissal: If the case has been settled, dismissed, or otherwise completed, upon providing notice to Ms. Liang the parties may be excused from appearing. All parties must appear unless they have received written notice that they are excused. If the plaintiff intends to dismiss an action in lieu of appearing, the dismissal and final disposition form must be filed no later than five 5 business days before the hearing, with a copy emailed to Ms. Liang. Consolidated Pre-Trial Orders: A consolidated pre-trial order CPTO and any motions in limine should be eFiled and a copy in Word version emailed to Ms. Liang no later than 12:00 PM on Tuesday, August 15, 2023, unless otherwise instructed by the Court. The following procedures are to be followed in the preparation and filing of CPTOs and supersede any provisions to the contrary provided by the parties: 1. The parties shall use the Court's Consolidated Pre-Trial Order, available in Word version by emailing Ms. Davis and attached as Ex. A. The Court's CPTO contains significant additions and modifications to Paragraphs 3, 5, 11, 14, 18, and 19. 2. Counsel shall consolidate the proposed pre-trial order. Failure of a party to submit its portion of the proposed pre-trial order may result in sanctions. Uniform Superior Court Rule 7.1. Motions in Limine: Except for unforeseen evidentiary issues, all motions in limine are to be filed contemporaneously with, or as a part of, the proposed CPTO. The Court will hear oral argument, if necessary, during the Pre-Trial Conference. Parties must confer before the Pre-Trial Conference to narrow the motions in limine for argument and must file responses thereto and advise Ms. Liang by email no later than 12:00 P.M. on Thursday, August 17, 2023 which motions are withdrawn or stipulated. Parties acknowledge that counsel are directed to notify the Court on the record at the time of any alleged violation, of the contention that the Court's ruling on a motion in limine has been violated during trial. Deposition Objections: Prior to trial, counsel shall make a good faith effort to resolve any objections in depositions to be presented at trial. All unresolved objections, together with the deposition transcript, argument, and citations, shall be eFiled, with a copy to Ms. Liang via email no later than 12:00 P.M. on Thursday, August 17, 2023. Conflict: If an attorney has a conflict, a conflict letter in full compliance with Rule 17.1 is REQUIRED. Filing a conflict notice letter does not excuse the parties from the deadlines in this Notice unless otherwise directed by the Court.
