JUDGE EDLEIN, CIVIL BENCH/DEFAULT EVIDENTIARY HEARING

In accordance with the Supreme Court of Georgias Orders, as amended, permitting courts to use technology to conduct remote judicial proceedings, the Court will conduct its Civil Bench/Default Evidentiary Hearing Calendar in-person and via videoconference. The following civil cases have been set for on the Courts Civil Bench/Default Evidentiary Hearing Calendar on Friday, December 15, 2023 at 1:30 P.M. via Zoom videoconference or in-person in Courtroom 2A, Justice Center Tower, 185 Central Avenue SW, Atlanta, GA 30303.ZOOM: The Court will use Zoom https://zoom.us/ which is available for free.1 All parties and witnesses must make sure they can appear in such a way to be seen and heard by the Court and all parties. Failure to appear or to present admissible evidence may result in dismissal of the Complaint or entering of judgment by default. This is a Court proceeding: Dress properly and be in an appropriate surrounding. The Zoom videoconference information is at the end of this notice. Parties may also request the electronic videoconference information by emailing the Courts Judicial Assistant, Kimberley Davis, at [email protected]. If a party does not have access to Zoom, s/he should email the Ms. Davis immediately.1 Information about getting started with Zoom is available at: https://support.zoom.us/hc/en-us/categories/200101697. REMOVAL/DISPOSITIVE MOTIONS: If a plaintiff files a motion for summary judgment or other dispositive motion, then this matter may be removed from this calendar upon the plaintiffs request. All such motions shall be efiled no later 12:00 P.M. on Friday, December 8, 2023 so the Court can remove the case and notify all parties. Plaintiff shall serve the motion consistent with the Georgia Civil Practice Act and Uniform Superior Court Rule 6.1.EVIDENCE: Plaintiff shall present evidence in compliance with the applicable rules of evidence. Parties will be allowed to share screen via Zoom so that the parties, the Court, and any witnesses are able to view the evidence. Parties should be familiar with Zoom and share screen.COURT REPORTER: Parties must request a court reporter no later than 12:00 P.M. on Friday, December 8, 2023 by emailing the Courts Staff Attorney, Lisa Liang, at [email protected]. There is a cost for the court reporter. Proceedings will not be transcribed absent timely notification.CONFLICTS: If an attorney has a conflict, a conflict letter in full compliance with Rule 17.1 is REQUIRED. If a self-represented party has a conflict, s/he must email Ms. Liang no later than Friday, December 8, 2023 at 12:00 p.m.INTERPRETER: If an interpreter is needed for a party or witness, the attorney or self-represented party must email Ms. Liang. Attorneys shall comply with new Uniform Superior Court Rule 7.3 in making such a request to Ms. Liang; failure to make a request by Friday, December 1, 2023 at 12:00 p.m. absent good cause, may result in the imposition of costs. TECHNOLOGY: The parties SHALL ensure they can use Zoom no later than Wednesday, December 13, 2023 at 12:00 p.m. Parties should do a Zoom TEST by going to https://zoom.us/test. If the parties are unable to access Zoom/technology issues arise, parties SHALL IMMEDIATELY email Ms. Davis or call 404 613-0490.CORPORATIONS: In Georgia courts, a corporation must be represented by an attorney licensed to practice law in Georgia and an attorney must sign all pleadings submitted to the court. See Eckles v. Atlanta Tech. Group, Inc., 267 Ga. 801, 804-05, 485 S.E.2d 22 1997; Unif. Sup. Ct. R. 4.3. A corporate officer may not represent the corporation in court unless that officer is also an attorney licensed to practice law in the State of Georgia. Unif. Sup. Ct. R. 4.3.Parties may have already received a written Order, setting their case for a hearing/trial on Friday, December 15, 2023 at 1:30 PM. To the extent a conflict exists between the Order and this Notice, the terms of the Order control.
