In accordance with the Supreme Court of Georgia's Orders, as amended, permitting courts to use technology to conduct remote judicial proceedings, the Court will conduct its Civil Bench/Default Evidentiary Hearing Calendar in-person and via videoconference. The following civil cases have been set for on the Court's Civil Bench/Default Evidentiary Hearing Calendar on Monday, August 21, 2023 at 1:30 P.M. via Zoom videoconference or in-person in Courtroom 2A, Justice Center Tower, 185 Central Avenue SW, Atlanta, GA 30303. ZOOM: The Court will use Zoom https://zoom.us/ which is available for free.1 All parties and witnesses must make sure they can appear in such a way to be seen and heard by the Court and all parties. Failure to appear or to present admissible evidence may result in dismissal of the Complaint or entering of judgment by default. If a party does not have access to Zoom, s/he should email the Ms. Davis immediately. REMOVAL/DISPOSITIVE MOTIONS: If a plaintiff files a motion for summary judgment or other motion on the issue of damages, then this matter may be removed from this calendar upon the plaintiff's request. All such motions shall be efiled no later 12:00 P.M. on Monday, August 14, 2023 so the Court can remove the case and notify all parties. Plaintiff shall serve the motion consistent with the Georgia Civil Practice Act and Uniform Superior Court Rule 6.1. EVIDENCE: Plaintiff shall present evidence in compliance with the applicable rules of evidence. Parties will be allowed to share screen via Zoom so that the parties, the Court, and any witnesses are able to view the evidence. Parties should be familiar with Zoom and share screen. COURT REPORTER: Parties must request a court reporter no later than 12:00 P.M. on Monday, August 7, 2023 by emailing the Court's Staff Attorney, Lisa Liang, at [email protected]. There is a cost for the court reporter. Proceedings will not be transcribed absent timely notification. CONFLICTS: If an attorney has a conflict, a conflict letter in full compliance with Rule 17.1 is REQUIRED. If a self-represented party has a conflict, s/he must email Ms. Liang no later than Monday, August 7, 2023 at 12:00 p.m. INTERPRETER: If an interpreter is needed for a party or witness, the attorney or self-represented party must email Ms. Liang. Attorneys shall comply with new Uniform Superior Court Rule 7.3 in making such a request to Ms. Liang; failure to make a request by Monday, August 7, 2023 at 12:00 p.m. absent good cause, may result in the imposition of costs. CORPORATIONS: In Georgia courts, a corporation must be represented by an attorney licensed to practice law in Georgia and an attorney must sign all pleadings submitted to the court. See Eckles v. Atlanta Tech. Group, Inc., 267 Ga. 801, 804-05, 485 S.E.2d 22 1997; Unif. Sup. Ct. R. 4.3. A corporate officer may not represent the corporation in court unless that officer is also an attorney licensed to practice law in the State of Georgia. Unif. Sup. Ct. R. 4.3.
